3. Service Description

SwingWatchlist provides the following services:

• Daily Stock Scans: Automated stock scanning based on technical analysis strategies
• Watchlist Management: Tools to organize and track stocks of interest
• TradingView Integration: Chrome extension for seamless navigation of watchlists on TradingView
• Symbol Organization: Upload, manage, and categorize stocks across multiple watchlists

4. Subscription Plans and Pricing

4.1 Available Plans

• FREE Plan: ₹0/month - 3 watchlists, 150 total symbols, daily scans (view & import), email support
• PRO Plan: ₹399/month - 10 watchlists, 500 total symbols, 30-day scan history, priority support
• PREMIUM Plan: ₹599/month - 25 watchlists, 1200 total symbols, 30-day scan history, premium support, early beta access

4.2 Billing

• All prices are in Indian Rupees (INR) and inclusive of applicable taxes
• Subscriptions are billed monthly on the date of purchase
• Payment is processed through Razorpay, our secure payment gateway
• Access is granted instantly upon successful payment verification

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription fee.

5. Cancellation and Refund Policy

5.1 Cancellation

• You may cancel your subscription at any time from your account settings
• Upon cancellation, you will retain access to paid features until the end of your current billing period
• After the billing period ends, your account will be automatically downgraded to the FREE plan
• No partial refunds will be issued for unused time in the current billing period

5.2 Refund Policy

5.3 Subscription Expiration

When your paid subscription expires or is cancelled:

• Your account will be downgraded to the FREE plan
• All your data (watchlists and symbols) will be preserved
• Access will be limited according to FREE plan restrictions
• You may upgrade again at any time

6. Account Responsibilities

6.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

6.2 Prohibited Activities

You agree NOT to:

• Share account credentials with others or allow multiple users to access a single account
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service
• Resell or redistribute access to the Service or any data obtained from it
• Reverse engineer or attempt to discover the source code of our platform
• Use the Service for illegal trading activities or market manipulation
• Violate securities laws or regulations in your jurisdiction
• Interfere with or disrupt the Service or servers
• Upload malicious code or attempt to compromise system security
• Impersonate any person or entity
• Harass, abuse, or harm other users or our support staff

7. Account Termination

7.1 Termination by User

You may terminate your account at any time by contacting our support team or using the account deletion option in your settings.

7.2 Termination by SwingWatchlist

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms and Conditions
• You engage in fraudulent payment activities
• You abuse or harass our staff or other users
• Your account is used for illegal activities
• We are required to do so by law or regulatory authority

No refunds will be issued for accounts terminated due to Terms violations.

8. Intellectual Property

All content, features, and functionality of SwingWatchlist, including but not limited to:

• Software, code, and algorithms
• Design, graphics, and user interface
• Scan strategies and technical indicators
• Logos, trademarks, and branding
• Documentation and guides

are owned by Nitesh (SwingWatchlist) and are protected by Indian and international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of data
• Uninterrupted or error-free operation
• Freedom from viruses or harmful components

10. Limitation of Liability

To the maximum extent permitted by law, SwingWatchlist and its owner shall not be liable for:

• Any trading losses or investment losses
• Loss of profits, data, or business opportunities
• Indirect, incidental, consequential, or punitive damages
• Service interruptions or technical failures
• Third-party actions or content

Maximum Liability: Our total liability to you shall not exceed the amount you paid for the Service in the three (3) months preceding the claim.

11. Data and Privacy

We respect your privacy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

• Data Collection: We collect only essential information for service delivery
• No Third-Party Sharing: We do not share your personal data with third parties except as required for payment processing (Razorpay) or as required by law
• Payment Security: All payment information is handled securely by Razorpay. We do not store your credit card or banking details
• Data Retention: Your watchlist and symbol data is retained as long as your account is active

12. Third-Party Services

Our Service integrates with third-party platforms:

• TradingView: For chart viewing and technical analysis
• Razorpay: For payment processing
• Google Sheets: For data export (admin only)

Use of these third-party services is subject to their respective terms and conditions. We are not responsible for their actions, policies, or service availability.

13. Modifications to Service and Terms

We reserve the right to:

• Modify or discontinue any feature of the Service
• Change subscription pricing with 30 days' notice
• Update these Terms at any time

Continued use of the Service after changes constitutes acceptance of the modified Terms. Material changes will be notified via email.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Tiruchirappalli, Tamil Nadu, India.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cancellation & Refund Policy, constitute the entire agreement between you and SwingWatchlist regarding the use of our Service.
